What does Child Maintenance cover?

When parents separate, ensuring that children continue to receive financial support is a top priority. This is where child maintenance comes in.

It is a regular payment made by the non-resident parent to contribute towards the child’s day to day living costs. But what exactly does it cover and what does it not include?

Our Family Law Solicitor, Danielle Cobb, explains:

“Child maintenance is intended to support a child’s basic, day to day needs – things like food, clothing, and a safe place to live. It ensures that the child’s quality of life is maintained as much as possible, even after their parents separate.”

What does child maintenance cover on a daily basis?

Child maintenance is designed to cover the essential living expenses of a child. This usually includes:

  • Food and groceries
  • Clothing and shoes
  • Housing costs (such as rent, bills, and utilities)
  • Basic household needs that allow a child to live in a safe and stable home

Does child maintenance cover school costs?

While child maintenance does not usually extend to private school fees or large extracurricular expenses, it does contribute towards everyday educational costs. These can include:

  • School uniforms and shoes
  • Books and stationery
  • Bus fares or travel expenses to and from school
  • School meals and packed lunches

Danielle Cobb notes:

“Parents are often surprised at how wide-ranging a child’s everyday expenses can be. From PE kits and homework supplies to school trips, child maintenance is there to meet those ordinary but important needs.”

Does child maintenance cover holidays and extracurricular activities?

Generally, child maintenance does not cover luxury expenses such as foreign holidays, private clubs, or costly hobbies. These “extras” are usually agreed between parents on a voluntary basis. However, many parents do choose to share these costs in addition to maintenance payments.

Case study: Reaching a child maintenance agreement

We recently assisted a mother of two young children following her separation from her former partner. The father was uncertain about what his payments should cover and was concerned about being asked to contribute to “extras” such as a school residential trip and new sports equipment.

  • Through careful negotiation, we were able to clarify the legal position and agree that his regular child maintenance payments would go towards the children’s essential living costs, including school uniforms, food and housing expenses.
  • The parents then voluntarily agreed to split the cost of the residential trip and sports activities, recognising the importance of supporting their children’s development.
  • This outcome ensured financial stability for the children while reducing conflict between the parents – a positive and practical solution for the whole family.

Why is child maintenance so important?

At Sinclair Law Solicitors, we see how vital financial stability is for children after separation. Danielle Cobb highlights:

“Child maintenance is not about one parent ‘paying the other’ – it’s about ensuring that children grow up with the resources they need to thrive. It is a responsibility, not a choice.”
